Kim Zolciak’s ex Kroy Biermann is seeking sole custody of their minor children.
According to court documents obtained by Us Weekly on Monday, March 30, Biermann, 40, asked a Georgia state judge to immediately change the pair’s current joint custody arrangement.
The former football player is seeking primary custody of his and Zolciak’s children KJ, 14, Kash, 13, and twins Kaia and Kane, 11. (Zolciak is also the mother of daughters Brielle, 28, and Ariana, 24, from previous relationships, whom Biermann legally adopted during their marriage.)
Biermann claimed in the filing that Zolciak, 47, had exhibited “blatant mismanagement of basic parenting responsibilities would be practically unbelievable to anyone not familiar with the circumstances.”
He alleged that Zolciak has been out of the country and has failed to exercise her parenting time. He also claimed that during one evening when Zolciak had the children, one of the minors was bitten by a dog.

Zolciak, for her part, responded to the allegations in a statement on Monday, telling Us, “These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for — something I will never apologize for. I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent , the truth is on my side, and it will come to light—no matter how hard anyone tries to bury it.”
Us has reached out to Biermann reps for comment.
Zolciak and Biermann have been entangled in a messy legal battle since their 2023 split. The pair filed for divorce in May 2023 after 11 years of marriage. The Real Housewives of Atlanta alum and Biermann have yet to come to a settlement as they’ve been at odds over multiple items, including custody of their minor children. Us previously reported that Zolciak and Biermann’s current custody plan allows them to each have two children at all times.
Last year, Biermann requested sole custody of the children. In an August 2025 filing obtained by Us, Biermann claimed that their kids lacked “proper parental guidance while in” Zolciak’s care as she “frequently leaves them alone or under the care of others for significant periods of time.”
Biermann also alleged that the children were subjected to “emotional and psychological abuse” by Zolciak. A rep for Zolciak adamantly denied the claims.

The following month, Zolciak exclusively spoke to Us about her ongoing divorce from Biermann.
“[I] don’t know if it’ll ever be over. I wish it would be over tomorrow,” she said while attending BravoCon 2025 in November 2025. “It’s just difficult. I’ve never not been able to coparent with my ex and things like that. So, this is just [what] I want. I want to be able to coparent and do what’s best for our children.”
Zolciak claimed that she has tried to work with Biermann when it comes to coparenting, but has ultimately been unsuccessful.
“If he needs help with having the kids somewhere, we can [help each other], but none of that happens,” she said. “So, it’s just the divide [that] is what’s so disturbing to me, like, we’ve had a good life. We were together for a long time. We have four beautiful kids. Can we just figure it out?”
