Mike Heslin’s husband has filed a wrongful death lawsuit against a Las Vegas restaurant, claiming the establishment failed to perform CPR on the actor in a “timely manner” before his death at age 30. 

Scotty Dynamo (real name: Nicolas James Wilson) filed a complaint on September 18 against Aria Resort and Casino, which owns Javier’s Las Vegas. According to court documents obtained by Us Weekly on Monday, September 22, Dynamo is suing on five counts of wrongful death, loss of consortium, negligence, gross negligence, and negligent hiring, retention, training and supervision. 

Dynamo confirmed Heslin’s death via Instagram on July 5, writing, “On July 2nd, my husband, best friend, and soulmate @mikeheslin passed away from an unexpected cardiac event after a week long battle in the hospital. Michael was young, in perfect health, and the doctors have no explanation for what happened.”

Dynamo’s September lawsuit claims that Heslin had been dining at Javier’s with two friends when he “collapsed.”

The suit continued, “It was immediately apparent that Michael was suffering from a medical emergency. Michael’s friends immediately started yelling out for help. [They] quickly moved the table back and away to get Michael on the floor — signaling distress that should have prompted immediate intervention.”

Then, “Over the course of the next several minutes, multiple employees of ARIA and/or JAVIER’S approached the scene of the incident and saw Michael exhibiting obvious signs of a medical emergency.”

The suit alleged that those employees “stood by, took no immediate lifesaving action, and failed to initiate or support efforts that could have saved Michael’s life.” They “failed to perform cardiopulmonary resuscitation (CPR) in a timely manner,” the complaint continued, stating that a woman began performing CPR on Heslin and was “forcefully removed” from doing so by an employee — ”preventing her from continuing compressions on Michael and interrupting this lifesaving measure.”

Dynamo accused the defendants of failing to “keep a stock and inventory of emergency response equipment” and “activate a known and expected emergency response protocol, including summoning trained personnel or securing and deploying an automated external defibrillator (AED), which was believed to be available on site.”

Dynamo is seeking $15,000 in damages. Us has reached out to the Aria Resort and Casino for comment.

Heslin had starred in Paramount+’s Lioness, Lifetime’s The Holiday Proposal Plan and Prime Video’s The Influencers, among other series. 

“Michael was brilliant, selfless, talented, and a real-life guardian angel,” Dynamo wrote in a July tribute on social media. “He single-handedly carried me through multiple rounds of cancer. He was the first person everyone would call to share good news with, and he was the perfect person to call if they needed a shoulder to lean on or the best advice. He truly was the sweetest, most caring, and loving man on earth, and he brought out the absolute best in everyone who had the pleasure to cross paths with him.”
